Criminal Justice (some of these are just cruel for the sake of cruelty)

Summary

  • States that The Attorney General “shall pursue the death penalty for all crimes of a severity demanding its use”

Executive Order: “Restoring the Death penalty and protecting public safety”

  • States that The Attorney General “shall pursue the death penalty for all crimes of a severity demanding its use”
  • States that the Attorney General must seek the death penalty, regardless of other factors, for every federal capital crime involving killing a law-enforcement office or a capital crime committed by an undocumented immigrant
  • The Attorney General must encourage State attorneys general and district attorneys to bring State capital charges for all capital crimes, with special attention to anything involving killing an LEO or crimes committed by an undocumented immigrant,  regardless of whether the federal trial results in a capital sentence
    • A capital crime is a crime that is eligible for the death penalty. So this means that states will be encouraged to seek the death penalty for all crimes where it is eligible, no matter the circumstances surrounding said crime
  • Biden commuted the sentence for 37 people who had been convicted of murder and were on death row, so that their sentences were life in prison, instead. This order states that the Attorney General must “evaluate the places of imprisonment and conditions of confinement for each” and “take all lawful and appropriate action to ensure that these offenders are imprisoned in conditions consistent with the monstrosity of their crimes and the threats they pose”
    • Note: So basically, try to put them in the worst prisons, so they live under the worst conditions possible
  • “The Attorney General shall further evaluate whether these offenders can be charged with State capital crimes and shall recommend appropriate action to state and local authorities”
    • Note: This part just made by brain blue screen entirely in its wtf-ness. It wouldn’t be considered double jeopardy, as you can be charged both at the federal and state level, but with the above notes about getting the states enforce the death penalty as much as possible, Trump just wants to kill these 37 people, no matter what, and wants to use every possible thing at his disposal to do so

Executive Order: Revoked Executive Order 14006 of January 26, 2021 (Reforming Our Incarceration System To Eliminate the Use of Privately Operated Criminal Detention Facilities

  • Stated that the attorney general would not renew any contracts with private prisons

Executive Order: Revoked Executive Order 14060 of December 15, 2021 (Establishing the United States Council on Transnational Organized Crime)

  • States that Transnational organized crime (TOC) poses a direct and escalating threat to public health, public safety, and national security, and so agencies should take actions enhance efforts to counter TOC
    • Note: I am very confused why Trump would revoke this unless, you know, or his cronies are doing Transnational organized crimes


Executive Order: Revoked Executive Order 14074 of May 25, 2022 (Advancing Effective, Accountable Policing and Criminal Justice Practices To Enhance Public Trust and Public Safety)

  • Asked that the Attorney General  assess the steps necessary to enhance the Department of Justice’s (DOJ’s) capacity to investigate law enforcement deprivation of rights under color of law
    • Note: Color of law means the appearance of legal authority or a legal right that does not actually exist
  • Heads of all Federal LEAs shall assess whether any of their respective agency’s policies or procedures cause unwarranted delay in investigations of Federal law enforcement officers for incidents involving the use of deadly force or deaths in custody, including delays in interagency jurisdictional determinations and subject and witness interviews, and shall, without abrogating any collective bargaining obligations, make changes as appropriate to ensure the integrity and effectiveness of such
  • Federal Bureau of Investigation (FBI) and all United States Attorneys to coordinate closely with the internal oversight bodies of Federal LEAs to ensure that, without abrogating any collective bargaining obligations, for incidents involving the use of deadly force or deaths in custody, initial investigative efforts (including evidence collection and witness interviews) preserve the information required to complete timely administrative investigations
  • The heads of all Federal LEAs shall assess whether any of their respective agency’s policies or procedures cause unwarranted delay or inconsistent application of discipline for incidents involving the use of deadly force or deaths in custody, and shall, without abrogating any collective bargaining obligations, make changes as appropriate
  • Establish an interagency working group to strengthen Federal law enforcement recruitment, hiring, promotion, and retention practices, with particular attention to promoting an inclusive, diverse, and expert law enforcement workforce
